1. Acceptance of Terms

By creating an account or using ArchiveHumanity ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. ArchiveHumanity is operated by MethodWare LLC.

2. Description of Service

ArchiveHumanity provides a platform for creating and hosting permanent digital memorials for deceased individuals. Users may upload photographs, biographical information, and other content, and generate QR codes that link to those memorials.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date. You must be at least 18 years old to create an account.

4. User Content

You retain ownership of content you upload. By uploading content, you grant ArchiveHumanity a non-exclusive, worldwide licence to store, display, and reproduce that content solely for the purpose of operating the Service. You are solely responsible for ensuring you have the right to upload any photographs or other materials, and that doing so does not violate the privacy or intellectual property rights of any third party.

You must not upload content that is unlawful, defamatory, obscene, or otherwise harmful. We reserve the right to remove content that violates these terms.

5. Payments and Subscriptions

Some features of the Service may require payment. All fees are stated in US dollars and are non-refundable except where required by law. Payment is processed securely through Stripe. We do not store your payment card details.

6. Service Availability

We aim to keep memorials accessible indefinitely, but we cannot guarantee uninterrupted availability. We will make reasonable efforts to notify users of any planned discontinuation of the Service with adequate notice.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service you consent to the collection and use of your information as described therein. We do not sell your personal data to third parties.

8. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your content may be permanently deleted.

9. Limitation of Liability

To the fullest extent permitted by law, MethodWare LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
